Proactive solutions

Proactive work is about preventing problems before they arise, and preparing properly for the moments when they do. It covers strategic and commercial advice, compliance reviews and gap analysis, stress tests, legal assurance, crisis and incident response planning, legal trackers and horizon scanning, due diligence before and after a sale or acquisition, and legal training and workshops.

Reactive solutions

Reactive work begins the moment something happens. It covers post-incident support, internal investigations, managing regulatory visits, RIDDOR reporting, enforcement notices and appeals, interviews under caution, defending criminal proceedings, and coronial law and inquests.

This includes handling regulatory interventions, investigations and criminal proceedings commenced by the Health and Safety Executive (HSE), Local Authorities (EHO), the Police and Crown Prosecution Service (CPS), Fire Authorities, the Care Quality Commission (CQC), the Office of Rail and Road (ORR), the Rail Accident Investigation Branch (RAIB) and Trading Standards.

  • Successfully challenged an enforcement notice issued by London Fire Brigade on a social landlord.
  • Advised a large social housing provider on the new requirements for fire and building safety.
  • Police, local authority and safeguarding investigation following the unexpected death of a young person in supported living accommodation.
  • Represented a housing association in the aftermath of a fire which burnt down a residential block, securing no further action, and separately in relation to a major carbon monoxide incident involving contractors.
  • Directors' duties and board governance training for social housing providers.

  • Acted as a trusted go-to adviser for a major contractor, supporting on approximately 25 RIDDOR reportable incidents, internal investigations, regulatory investigations and criminal proceedings.

  • Represented a contractor at an inquest involving an apprentice fatally injured carrying out cable laying and trench work.
Rail
  • Represented a rail maintenance company following a serious workplace accident which caused injuries to an employee and a potential derailment of a mainline running train.
  • Delivered directors' duties, roles and responsibilities training for a rail infrastructure client.
  • HSE investigation and prosecution concerning a finger amputation from unguarded machinery.
Real Estate and Built Environment
  • Provided advice to various commercial landlords about the extent of health and safety responsibilities arising in relation to premises.
  • Delivered a legal health check and compliance review for a developer of its CDM arrangements and competency framework.
  • Advised a commercial landlord on legal obligations arising in relation to trespassers, and the steps needed to discharge health and safety obligations in relation to dilapidated premises.
Manufacturing
  • Provided advice on legal requirements for designers and manufacturers of building products.
  • Trading Standards and coroner's investigation following a fatal accident where storage racking collapsed on an apprentice.
  • HSE investigation and prosecution following two separate guarding incidents.

  • Successfully defended an organisation and a director from corporate manslaughter and gross negligence manslaughter following a fatal fall from height.
  • Successfully defended an individual from criminal neglect in the care sector.
  • Represented a telecommunications company at an inquest where a staff member took their life whilst placed at risk of redundancy.
  • Assisted with various internal investigations for a contractor involved in asbestos work, gas work, traffic management and falls from height.
  • Delivered a legal health check and stress test for a utilities company.
  • Delivered Building Safety Act legal training to various contractors and designers.
  • Advised a private children's day nursery on a major pest infestation, including initial crisis management support, remedial actions, steps to reopen, the internal investigation process and support during the local authority and environmental health investigation.
